What if my ncp refuses to file taxes on jobs to prevent IRS interception and payment of owed money to me?



My sons father owes close to $8,000.00 in back support and even though he has 1099"s from jobs worked off and on he refuses to file . I haven't recieved any payment in 90 days now atleast and I can't seem to get help with both states{ where he lives and my current state of residency } or with Supportkids...He is flagged for IRS interception but why isn't anything being done to make him file return? Also they can't get in contact with him and have no current address acording to his grandmother at last known....he was on some sort of probation for other criminal activity and probation should have accurate address right? Why can't CSE call law enforcement OR state DOC? What do I do? Is there anyone who can/will help? My sons father lives in Colorado if this helps any. Thank You.

If he is receiving 1099s, most likely taxes are not being withheld. In that case even if he files a return, there is not refund to take. The IRS can't make him pay more than his tax liability just so the excess can be used to pay child support.
What if taxes were withheld? For example , a job at walmart? W-2"s? Not 1099"s.....

The IRS will penalize him for not filing, but can't make him pay in enough to cover his taxes AND the back child support. If he's working on 1099's, unless he's made estimated payments which seems unlikely under the circumstances you describe, there's no refund to be seized. There's probably not much that you or anyone else can do about it. If he's going to be a sleaze, that's what he will be. Good luck.
In Massachusetts when a company has a new hire, either an employee (W2) or contractor (1099), the company has to file a list of new employees quarterly. The state will then cross check this list with parents owing back child support and force the company to with hold child support from their pay.

Maybe Colorado has similar law.
